SCHEDULER TERMS OF USE (“TERMS OF USE”)

Please read these Terms of Use (‘Terms’, ‘Terms of Use’) carefully before using the Schedules Made Simple website or mobile application (the ‘Service’) operated by Schedules Made Simple, LLC, a California Corporation (‘us’, ‘we’, or ‘our’).

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

Calculations

You understand and agree that all time and pay calculations performed by the Service, including overtime hour and pay estimates, are for planning purposes only. You agree to be fully and solely responsible for adherence to all local, state and federal laws and regulations that pertain to scheduling and compensating your workers.

Notifications

By using our service, you agree that you are solely responsible for the accuracy and delivery of schedule times and notifications sent by the Service to workers by text message, email, mobile device notification, web page or print. Furthermore, you agree and understand that all other operations of the Service, including but not limited to, work preferences and shift trades, may be subject to inaccuracies and other failures.

Accounts

When you create an account with us, you must provide us information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.

NO WARRANTY

You expressly acknowledge and agree that use of the service is at your sole risk. Some jurisdictions do not allow the limitation of liability for personal injury, or of incidental or consequential damages, so this limitation may not apply to you. In no event shall schedules made simple, llc’s total liability to you for all damages (other than as may be required by applicable law in cases involving personal injury) exceed the amount of fifty dollars ($50.00). The foregoing limitations will apply even if the above stated remedy fails of its essential purpose.
